Records Division Policies and Procedures
Report Release Policies
- Case Reports.
- Nobody,
with the exception of other law enforcement agencies, governmental
agencies, or persons in possession of a valid subpoena, will be given
a copy of an entire investigation including investigative
supplements. Only a
copy of the initial Case Report will be released, unless the
person requesting the Case Report falls under one of the
exceptions listed above.
- Under
no circumstances will a suspect or person arrested in a specific
case be allowed to examine or request a copy of the Case Report. Arrested persons should be directed to contact their
attorney to file a motion for discovery.
- In
the event that the release of a copy of a Case Report would
jeopardize an ongoing investigation, a press release will be
completed by the Shift Commander that includes: the time, date and
location of occurrence, the name and age of any victims unless the
victim was a victim of a sex crime in which case the name and age
should not be released, the factual circumstances surrounding the
incident and a general description of any injuries, property
stolen or damaged and any weapons involved. There is no duty to furnish the victim’s exact address,
only the street name and block number. If an arrest was made, the press release should include:
the name, address and age of the person arrested or summoned,
charges on which the arrest or summons was based, circumstances of
the arrest or issuance of the summons and the time, date and
location of the arrest or issuance of the summons and the
investigating officer’s name and agency unless he/she is an
undercover officer.
- Any
citizen, unless they are a suspect or acting on the behalf of a
suspect, insurance company or attorney has the right examine the
initial Case Reports at any time and may request copies of any
initial Case Reports, but may not view or copy any of the
investigative supplements for that Case Report unless they fall
under one of the exceptions listed above.
- There
will be no charge for copies of Case Reports generated by the
LaPorte Police Department unless the Case Report is more than ten
pages in length in which case a copying charge of $.10 per page
will be charged.
- Only
Records Division personnel will distribute copies of Case Reports.
- Identification
will be required from all persons requesting copies of Case
Reports and a log will be kept of all persons obtaining copies.
- Crash Reports.
- Citizens,
insurance companies and attorneys may examine the Crash Reports at
any time.
- Copies
of Crash Reports will be furnished to all citizens, insurance
companies or attorneys who request a copy and pay a $5.00 fee. A law enforcement agency has the authority to set fees for
copies of Crash Reports under IC 9-29-11-1. Any person requesting that a copy of a Crash Report be
faxed to them must have an account with the LaPorte Police
Department or pay the applicable fee before the Crash Report will
be faxed to them. The current fee for copies of Crash
Reports is $5.00.
- Only
Records Division personnel will distribute copies of Crash
Reports.
- Criminal Records Checks.
- Citizens
requesting that a Criminal Records Check be completed on
themselves must complete, sign and submit Request for Limited
Criminal History Information before the Criminal Records Check
will be done.
- The
person requesting the Criminal Records Check must complete all
pertinent information on the Request for Limited Criminal History
Information form and pay the appropriate fee, $7.00, unless one of
the fee exempt conditions listed on the Request for Limited
Criminal History Information form is applicable or the agency
requesting the information is a law enforcement agency or military
service. A law
enforcement agency has the authority to charge a $7.00 fee for
Criminal Records Checks under IC 5-2-5-7. There will be no exceptions.
- Criminal
Records Checks will include only information on arrests and/or
convictions on charges filed by the LaPorte Police Department.
- Only
Records Division personnel will do Criminal Records Checks. There will be no exceptions.
Fingerprints for Employment and Other Purposes
- A $10.00 fee will be charged on all fingerprints taken for employment and
other purposes, with the exception of Handgun
Permit Applications, which we already charge a processing fee for.
- If
the person fingerprinted is a juvenile, the juvenile and his/her
parents must sign a waiver of liability.
Handgun Permits
- Overview
- The issuance of handgun permits is governed by the State of Indiana
Firearms Act under Indiana Code IC 35-47-1. The LaPorte City Police
Department strictly follows the State of Indiana Firearms when processing
all handgun permit applications.
- Requirements
- The applicant must reside within the LaPorte City limits. It should be
noted that the State of Indiana Firearms requires that applicant
living within the city limits of a municipality apply at the law enforcement
agency of the city or town. If the applicant lives outside the city
limits of any municipality, then they must apply to the law enforcement
agency having jurisdiction, which is normally going to be their county
sheriff's department. Therefore, the LaPorte City Police Department
cannot process handgun permit applications for LaPorte County residents that
do not live within the city limits. Those applications must be
processed by the LaPorte County Sheriff's Department. Absolutely no
exceptions will be made.
- The applicant must fully complete the LaPorte City Police Department
Application for Handgun Permit and bring the application to the police
station between the hours of 8:00 AM and 3:00 PM Tuesday through
Friday. You do not need to make an appointment.
- Effective July 1, 2006 application fees are as follows.
- For a four year Personal Protection Permit, a money order in the amount of
$30.00 made out to the State of Indiana and $10.00 cash for the LaPorte
City Police Department's processing fee.
- For a four year Hunting and/or Target Permit, a money order in the amount of
$5.00 made out to the State of Indiana and $10.00 cash for the LaPorte
City Police Department processing fee.
- For a lifetime Personal Protection Permit, if the applicant
currently has a valid handgun permit, a money order in the amount of
$60.00 made out to the State of Indiana and $40.00 cash for the LaPorte
City Police Department's processing fee.
- For a lifetime Hunting and/or Target Permit, if the applicant
currently has a valid handgun permit, a money order in the amount of
$20.00 made out to the State of Indiana and $40.00 cash for the LaPorte
City Police Department processing fee.
- For a lifetime Personal Protection Permit, if the applicant does not
currently have a valid handgun permit, a money order in the amount of
$75.00 made out to the State of Indiana and $50.00 cash for the LaPorte
City Police Department's processing fee.
- For a lifetime Hunting and/or Target Permit, if the applicant does
not currently have a valid handgun permit, a money order in the amount of
$25.00 made out to the State of Indiana and $50.00 cash for the LaPorte
City Police Department processing fee.
- The State of Indiana Firearms Act prohibits the issuance of handgun
permits to persons that meet any of the following criteria.
- A person who has a conviction for Resisting Law Enforcement in the
five years preceding the permit application.
- A person who has a conviction for a crime for which they could have
been sentenced to more than a year.
- A person who has a record of being an alcohol or drug abuser as
defined in the above listed Indiana Criminal Code.
- A person who has documented evidence that would give rise to a
reasonable belief that he/she has a propensity for violent or
emotionally unstable conduct.
- A person who made a false statement of material fact on his/her application.
- A person who has a conviction for any crime involving an inability to safely handle
a handgun.
- A person who has a conviction for any violation of the provisions of this article
within the five years preceding his/her application.
- It should be noted that any person giving false information or offering
false evidence in order to get a handgun permit will be charged with a felony.
Upon conviction, he/she could be sentenced to up to five years in prison and be
required to pay a $10,000 fine.
- Duplicate Handgun Permits
- The LaPorte City Police cannot assist you in any way in getting a
duplicate handgun permit.
- The only way to obtain a duplicate handgun permit is to send a letter to the
Indiana State Police containing your full name, your date of birth, current
address, the reason for the request for a duplicate permit and a $5.00 money
order made out to the State of Indiana to the following address.
